Without a will, the Probate Act directs to whom the assets will be distributed. Wills are particularly important for parents of minor children so that they can appoint guardians who will care for the children upon the parents' deaths.
Trusts are another estate planning tool that helps manage assets before and after death. A trust transfers the administration of a person's property to another person or institution, known as the trustee, who manages and distributes the assets for the benefit of, as well as to a beneficiary.
